Acceptable Use Policy

This Acceptable Use Policy, including the list of prohibited activities below, forms part of the Terms of Service. Where a signed agreement between you and RTM Networks B.V. says something different, the signed agreement applies, then the Terms of Service, then this Policy.
Where you breach this Policy we will tell you in writing, with reasons, and give you five working days to stop the activity, resolve its consequences and undo the damage caused. If it is not resolved in that time, or the same problem returns, we may suspend or end the service. We act immediately, without that period, only where the traffic is unlawful, where it is actively harming third parties, where a competent authority requires it, or where it puts our standing with a registry or an upstream at risk.
RTM Networks B.V.'s Acceptable Use Policy (the "Policy") for RTM Networks B.V. Services is designed to help protect RTM Networks B.V., RTM Networks B.V.'s customers and the Internet community in general from irresponsible or, in some cases, illegal activities.
The Policy is a non-exclusive list of the actions prohibited by RTM Networks B.V.
We may change this Policy. We publish the new version and give at least 30 days' notice before it takes effect, as set out in the Terms of Service.
Prohibited Uses of RTM Networks B.V. Systems and Services
1.
Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.

Sending Unsolicited Bulk Email (UBE, spam). Sending any form of Unsolicited Bulk Email through RTM Networks B.V.'s network is prohibited. Likewise, sending UBE from another service provider advertising a web site, email address or any resource hosted on RTM Networks B.V.'s network is prohibited. Accounts or services may not be used to solicit customers from, or collect replies to, messages sent from another Internet Service Provider where those messages violate this Policy or that of the other provider. Legitimate bulk email is permitted; see the next item for what that requires.

Running Unconfirmed Mailing Lists. Subscribing email addresses to any mailing list without the express and verifiable permission of the email address owner is prohibited. All mailing lists run by RTM Networks B.V. customers must be Closed-loop ("Confirmed Opt-in"). The subscription confirmation message received from each address owner must be kept on file for the duration of the existence of the mailing list. Purchasing lists of email addresses from 3rd parties for mailing to from any RTM Networks B.V.-hosted domain, or referencing any RTM Networks B.V. account, is prohibited.

Advertising, transmitting, or otherwise making available any software, program, product, or service that is designed to violate this AUP or the AUP of any other Internet Service Provider, which includes, but is not limited to, the facilitation of the means to send Unsolicited Bulk Email, initiation of pinging, flooding, mail-bombing, denial of service attacks.

Operating an account on behalf of, or in connection with, persons or firms listed in the Spamhaus Register of Known Spam Operations (ROKSO) database at www.spamhaus.org/rokso, or subleasing address space to them.

Unauthorized attempts by a user to gain access to any account or computer resource not belonging to that user (e.g., "cracking").
7.
Obtaining or attempting to obtain service by any means or device with intent to avoid payment.
8.
Unauthorized access, alteration, destruction, or any attempt thereof, of any information of any RTM Networks B.V. customers or end-users by any means or device.
9.
Knowingly engage in any activities designed to harass, or that will cause a denial-of-service (e.g., synchronized number sequence attacks) to any other user whether on the RTM Networks B.V. network or on another provider's network.
10.
Using RTM Networks B.V.'s Services to interfere with the use of the RTM Networks B.V. network by other customers or authorized users.
11.
Running an open proxy, an open mail relay or an open recursive resolver. VPN, proxy and other privacy services are permitted, but you must keep a monitored abuse contact, act on complaints we forward, and be able to identify and stop abusive traffic from the addresses. Public Tor exit nodes require our prior written consent, which we will not unreasonably withhold.
12.
Announcing address space you have no Letter of Authorization for, announcing from an AS number we have not authorised, announcing more specific prefixes in order to draw traffic away from another holder, spoofing source addresses, or creating a Route Origin Authorisation that conflicts with the one we maintain.
13.
Hosting or distributing material that is unlawful, including child sexual abuse material and terrorist content. We act on a valid notice under the Digital Services Act, and terrorist content is removed within one hour of an order from a competent authority.
